CAPPA Children's Foundation July Statewide Meeting

At the request of some of you, CAPPA has created a registration form for the July Statewide Meeting.  This form has all of the hotel information, along with dates and times of the workshops.  The only thing it does not include are the workshop titles and descriptions.  CAPPA is working on putting a program together for you.  As soon as there is an update, we will send that out.
In the meantime, if you are interested in attending, please fill out the attached registration form and send it in to CAPPA.

April Statewide Meeting Room Block Sold Out!

As of today, our room block at the Hilton is sold out.
There are still rooms available, just not at the discounted rate.  When you call reservations, they are quoting a rate of $199.  I would suggest trying a website like Travelocity.  I checked Travelocity for those dates and they quoted me $179.

Governor Vetoes SB 867(Cedillo) Child Care Collective Bargaining Legislation

Governor Schwarzenegger vetoed SB 867 today citing the states looming budget deficit as his reason. CAPPA wishes to thank all of those that sent in letters opposing the legislation. This was the 5th attempt to unionize child care providers.

CAPPA Board Election Ballot

Please vote for two candidates for Member at Large by visiting the link below.  Each position is for a two-year term.  Only one vote per CAPPA agency is allowed.  If you are not the voting delegate for your agency, please give the ballot to the voting delegate. Per the CAPPA bylaws, members in good standing can either vote electronically or respond with a mailed hard copy ballot.  If submitting a vote electronically, you must include the name of the voting delegate with contact information that can be confirmed by Friday February 22, 2008.  If responding by a hard copy mailed or faxed ballot, the deadline is by February 22, 2008 (postmarked no later than February 21st) to the CAPPA Office, 1555 River Park Drive, Suite 202, Sacramento, CA 95815, or (916) 567-6790.

January Statewide Meeting: Early Registration!!

For those who will be arriving on Tuesday, January 15 at the Radisson Newport Beach, CAPPA will be setting up a registration table for early registration.
If you want to beat the rush, the table will be set up in the hotel lobby from 3:00pm-6:00pm.

Vote Needed for CAPPA Proposed Bylaws Changes

This set of proposed changes to the CAPPA Bylaws must be presented for vote to each CAPPA Member agency (a Contractor with the California Department of Education) in good standing who has paid CAPPA membership dues. 
Please click here to download an official ballot.  Remember, only one vote per agency. 
The deadline to submit your ballot is January 18, 2008 by 5:00 p.m.  The Bylaws will be amended only if approved by a majority of those that have submitted a ballot by the deadline noted above.

The California Department of Education has released the Needs Regulation Package for comment.  Please review, as this will be the last time they will be released for public comment.

In anticipation of the implementation of both the Need and Eligibility Regulatory Packages, CAPPA is partnering with CDE to deliver an all day training program to the field.

According to CDE “The ERS Eligibility regulations were approved by the Office of Administrative Law on 8/16 and will be effective 9/15. Even though they are effective [September 2007], implementation will be delayed until the ERS Need regulations are finalized [January 2008].”

Due to the wonderful response from the CAPPA membership in the past CAPPA has been able to provide accurate and timely information to legislators and their staff. From this proven ability CAPPA has become a coveted rsource and a go-to for information. In order to keep this tradition alive CAPPA would like to encourage you to take the time and fill out the 2008 Advocacy Questionnaire. Once we receive the questionnaire responses we will compile the information into a central document and use that data to produce fact sheets, district specific data for legislators, talking papers, etc.

CAPPA's Executive Only Session

*Note: This Session is Invite ONLY.

On February 13, 2008, CAPPA will convene an executive only session focused specifically on the issue of State and Federal challenges to the classification of child care providers.
Helping to facilitate this session will be outside legal counsel secured by CAPPA experienced in all issues surrounding independent contractors and challenges to that classification.  The agenda is being compiled by member executives from our field.  If you have a specific issue or question that you want addressed, please forward to the Denyne at denyne@cappaonline.com.

Update: CDE Releases Need Regulations for 15-Day Comment Period

The California Department of Education has released the Need regulations for a 15-day comment period starting on Thursday, November 15th and ending on Thursday November 29th. This may be the last time that the Need regulations go out for public comment before they are submitted to the Office of Administrative Law (OAL). The department must submit a completed set by January. If they do not have a completed set by that time then they will have to start the whole process over. OAL law states that a regulations package must be finished within one year.

New Federal Error Rate Regulations for CCDF Programs

During CAPPA conferences over the last two years, the Child Development staff have been talking about the federal Improper Payments Information Act (IPIA) and advising that regulations implementing its provisions in CCDF child care programs may be forthcoming.  On September 5, 2007, they arrived.
 
The IPIA requires that federal agencies identify programs susceptible to significant improper payments and estimate the rate of improper payments in those programs.  The purpose of this process is to create a mechanism to reduce improper payments nationwide. Click here for the rest of the article.

Governor vetoes AB 1164 (DeLeon) - Child care provider unionization

Once again, CAPPA is pleased to let you know that the effort to unionize child care providers has failed.  See the governor's veto message below.
 
Having noted this veto message, we as a field must not be complacent in thinking that this issue will go away.  I can guarantee you that this issue will be back with a vengeance next year.  When we continue to talk about this issue, we must move forward to offer input to a proposal that clarifies:
 
1) that child care providers are independent contractors;
2) that any proposed change of this magnitude to the child care subsidy field come with a hold harmless clause for our agencies and for the children and families that we serve; and
3) that no effort can be supported until such time that data and documentation can support such a change as fiscally supported under the constraints of California's current regional market rate system.
 
CAPPA has been successful in leading the effort to oppose this issue.  We intend to continue in that role and will not let up until at a bare minimum the issues noted above are clarified.

Governor Schwarzenegger's Veto Message

To the Members of the California  State Assembly:
I am returning Assembly Bill 1164 without my signature.
While I support efforts to improve the quality of child care services and have provided increased state funding to expand access to subsidized child care, I can not support this bill as it has the potential to add significant fiscal pressures to the State’s structural budget deficit. Family childcare homes currently receive prevailing market rates for their services. They are reimbursed for the state-subsidized families they serve at the same rate as that paid by the non-subsidized families they serve.
Changes in the current reimbursement structure, increases in family child care provider reimbursement rates, expanded provider training efforts, or other program enhancements could come at the expense of the number of available child care slots. In light of the current structural budget deficit, it is imperative that we balance our fiscal reality and the need to provide services to working families.
For these reasons, I am unable to sign this bill.

Breaking News: CAPPA Bill (AB 1571) Signed By Governor

Today the Governor signed and Chaptered into law AB 1571(DeSaulnier). Earlier this year CAPPA met with Superintendent Jack O’Connell to discuss issues affecting Alternative Payment Programs and from those conversations the California Department of Education staff and CAPPA started an APP Taskforce. The task force was designed to discuss contract barriers, unspent monies, streamlining issues, etc. From these meetings the move to fix the contingency fund was started and this legislative session CAPPA sponsored AB 1571 with Assemblyman DeSaulnier’s help. Thank you to everyone who heeded the calls for support letters, testimony, etc. We couldn’t have done it without all of your help. Today is a great day for Alternative Payment Programs and we hope that this bill will lead to more children and families being served in the coming years.
