The Budget Act of 2017 required the CDE to convene a workgroup to solicit input for developing regulations regarding the provisions of California Education Code 8263(h), 12-month eligibility. In order to garner as much input as possible, the EESD Policy Office opened an e-mail address to gather input/recommendations from any interested party. This e-mail address was open until February 28, 2018, which was the deadline for stakeholder's to submit their input.

The input/recommendations submitted to CDE will be considered in the drafting of the regulations. As part of the rulemaking process, once the regulation changes to the California Code of Regulations, Title 5, are written, there will be an opportunity for public comment before the regulations are finalized, through the Office of Administrative Law. 

The Office of Administrative Law (OAL) rulemaking process will be followed, which includes public comment periods.

Although CDE has not yet proposed a timeline, the law states that the department is to initiate a rulemaking action to implement the provision on or before December 31, 2018. The bill would require the department to convene a workgroup of parents, advocates, department staff, child development program representatives, and other stakeholders to develop recommendations regarding implementing the provision. Pursuant to the requirements of Government Code section 11346.4(a), the State Superintendent of Public Instruction is providing notice of the proposed regulatory action with regards to the above-entitled regulations. The proposed regulatory action can be found HERE

The public commentary period begins on April 22, 2017 and ends on June 5, 2017.
